Article 1 - Définitions :
Is referred to as CUSTOMER the BeeBip User.
Is referred to as SOFTWARE the program installed on the customer's computer.
Is referred to as SERVICE any service provided by SINFONI IT through the use of BeeBip software.
BeeBip is a registered trademark of SINFONI IT. BeeBip logo and the character are the exclusive property of SINFONI IT and are registered.
BeeBip comprises the Service and the Software.
SINFONI IT is a limited company with capital of 57500€00 registered under number RCS LILLE B 480 334 184. Headquarters : 85b rue Nelson Mandela 59120 LOOS FRANCE.
SINFONI IT provides SOFTWARE and SERVICE for
•Physically locate a stolen computer reconnected to the Internet
•Identify the fraudulent user
•Retrieve remotely data from the customer's computer
•Destroy data remotely on the computer of the CUSTOMER
Article 2 - the SOFTWARE
2.1 Installation
The customer installs the software on his computer preventively. For the installation work, the customer must provide a valid email address. The installation program creates no entry to uninstall the SOFTWARE, and no shortcut to the customer to interact with the software directly from the computer.
If the Customer has no www.beebip.fr account, this account is created during installation.
If the customer already has an account on www.beebip.fr, the installation will be attached to this account.
The only way to interact with the SOFTWARE is to login at www.beebip.fr (access codes provided when creating the account) to access the management interface. Since this interface, the CUSTOMER may

Simulate the theft computer to ensure proper operation of the SOFTWARE

Uninstall the Software

2.2
Privacy and Data Security
When installing the SOFTWARE, CUSTOMER should choose a 6 digits code. This code is used as the encryption key when retrieving data remotely. Only the customer is aware of this key. This guarantees that the CUSTOMER is the only one who can read the recovered files remotely. Similarly, the order for remote destruction of files can only succeed if the Customer provides the correct 6 digits code.
2.3
Trial version
BeeBip is available as a free trial and paid versions. During the evaluation period, the computer and its data are protected in the same way as if it were a paid version. In the case where the computer is stolen during the evaluation period, this period is automatically extended for a maximum of 60 days from the date of declaration of theft to our services.
2.4
Standard Version
The Standard version includes all the services to be implemented in case of theft of computer: remote data recovery, remote data destruction, management and follow-up.
The license is valid for one year (one year) as of the date of installation. Until the license is assigned to any computer, it remains valid indefinitely. Once the license assigned if the date of expiry is reached, the software stops working if the Customer does not acquire a new license or assign a license still valid at the respective computer.
2.5
Family Version
The Family Version includes all the services to be implemented in case of theft of computer: remote data recovery, remote data destruction, management and follow-up. Each license allows you to equip up to 5 computers. This license is reserved exclusively for private use within the family. This license may never be used on a computer whose use is professional and / or property of a company. Failure to comply with this requirement will invalidate the license and free SINFONI IT of any obligation to the CUSTOMER without any compensation being required by the CUSTOMER.
The license is valid for 1 year (one year) as of the date of purchase. When the date of expiry is reached, the software stops working on all computers if the Customer does not acquire a new license. Any unused licenses before that date are no longer usable and can not give rise to any reimbursement or compensation of whatever kind.
2.7
License expiration on a stolen computer
If the date of expiry is reached while the computer was stolen before that date, the validity of the license is extended by a maximum of 60 days from the date of declaration of theft to our services.
Article 3 - Liability limits :
The Customer remains solely responsible for the data from his equipment. Accordingly, the customer must take all precautions to ensure the backups of their personal data. Responsibility for SINFONI IT if total or partial loss of data regardless of kind can never be committed.
Article 4 - Obligations of SINFONI IT :
SINFONI IT is committed to providing the technical and human resources necessary to carry out the services defined in these Conditions. SINFONI IT undertakes no obligation to produce results on the physical recovery of a stolen computer, data recovery or destruction. However, SINFONI IT is committed to an outcome regarding the detection of stolen computer. This detection is to collect at least one IP address after the computer theft and that within 60 days. In the event that no detection would be made for any reason within this period, SINFONI IT will reimburse the Customer up to the price of the license currently valid assigned to the computer stolen in accordance with the provisions described in Article 6 of these general conditions of sale. Reimbursement may only relate to the price actually paid for the license purchase. In the particular case of a Value Pack, costs of file retrieval, destruction of files and tracking are extra and only the license fee can be refunded. SINFONI IT is committed to respecting the privacy of its guests. No personal data is collected during SERVICES. No files are retrieved from the customer's computer without his knowledge. Only the report of theft of the computer by the customer can trigger the retrieval of files from the customer's computer. In this case, these files are encrypted using a key known only by the CUSTOMER. In all cases, no personal data is accessed by our stakeholders in any form whatsoever, including, without limitation, text files, images, word files, excel files. SINFONI IT will not transmit any information on its customers to third parties for marketing purposes in any form whatsoever, including, without limitation, phone calls, e-mail (spam), postal mail, doorstep.
Article 5 - Customer Obligations :
The Customer undertakes to keep available to SINFONI IT all the documents proving that he is the owner of the equipment on which he has installed the SOFTWARE. In case of theft, the CUSTOMER further undertakes to provide to SINFONI IT all documents relating to the filing of a complaint for theft of equipment.
Article 6 - Cost and payment of SERVICES and SOFTWARE :
Payment by the CUSTOMER is made by one of the payment methods available to him:
Paypal (paypal account or credit card payments).
Credit card.
Check. (Customer assumes all costs relating to the payment by check.)
Bank transfer. (Customer assumes all Costs Relating To The Payment by bank transfer)
The license fee paid for the Standard and Family versions includes SOFTWARE AND SERVICES for the provision of location and identification information to the police, data recovery at the request of the CUSTOMER and the destruction of data at the request of the CLIENT. In the case where the computer is not detected within 60 days after the declaration of the theft to SINFONI IT and this report to our services has took place within 8 hours after the theft (date and the time shown on the complaint authentic) the license currently valid will be refunded to CUSTOMER. For the Family version, the refund will be calculated on the basis of 1 / 5 (fifth) of the total price of the license per stolen computer not detected. The computer is considered detected when the device was able to collect at least one IP address.

We consider that there is transformation of a trial to a paid version when it takes at least 3 days (72h00) between the installation of the SOFTWARE on the CUSTOMER's computer and the assignment of a paid license this computer.
It is not possible to convert a trial to a paid version on a computer already reported stolen.
The declaration of theft of a computer is possible only after a waiting period of 3 days (72 hours) after the transformation of a trial to a paid version. Before this period, reporting the theft causes the billing.
The customer may purchase as many licenses as he wishes. A license is valid for a specified period (usually 1 year). For a Standard license, the duration is counted from the moment the client assigns the license to a computer. For a Famimy or Value Pack license, the validity period is counted from the date of license purchase. License Standard not assigned to a computer remains valid indefinitely.
In the case where the computer would become unusable for any reason, no refund can be made in proportion to the unexpired period. However, the license may be transferred to another computer. This applies even if the CUSTOMER uninstalls the SOFTWARE. The license becomes transferable to another computer of the same CUSTOMER.
Dates alignment
In the event that the customer has multiple computers with BeeBip, with dates of expiry different, it can harmonize these dates since its customer area. The calculation is to count the sum of days of validity remaining on all computers, divide that number of days by the number of computers being protected, and assign to each one the number of days from the date. The calculation automatically rounds the number of days to the nearest whole number. The result is a possibility of losing several days of protection.
Value Pack licenses can not be aligned with Standard and Family licenses.
The customer can see and manage at any time all of its licenses, affected, unaffected or reassignable by visiting his customer area at www.beebip.fr. The customer may assign at any time a license to one of his computers in the same area, renew a expired license, or extend a currently valid license. If the CUSTOMER assigns a license to a computer that already has a valid license, the total duration of validity of the resulting license is the sum of the durations of each license. Example: A computer with a license valid for 6 months which is assigned with a new license for a period of one year will have a valid license for a total duration of 1 year and 6 months.

Article 7 - Rates :
The rates for services and SOFTWARE are in euros including all taxes (VAT).
Rates are available on www.beebip.fr.
The rates for services and software are subject to change without notice.
Article 8 - Privacy Notice :
According to French law Informatique et Libertés No. 78-17 of 6 January 1978 and its implementing regulations, the customer has a right to access, modify, correct or delete personal data concerning him, exercisable to SINFONI IT, 85b rue Nelson Mandela, 59120 LOOS FRANCE. CUSTOMER authorizes SINFONI IT using its contact information including e-mail, to communicate commercial offers or as part of a quality (satisfaction surveys, monitoring interventions,...). If he refuses, the Customer will notify SINFONI IT his refusal to see their data used by registered mail with return receipt stating its coordinates (the identity of the individual concerned, address, customer number).
Unless otherwise indicated, SINFONI IT may make reference to the CUSTOMER as a business reference, provided that it is limited to his firstname, the first letter of his name and his city and country residence.
Article 9 - Applicable Law :
Express agreement, this contract will be governed by French law. These terms and conditions shall not be construed as limiting the statutory rights of the CUSTOMER and nothing limits the consumer's statutory rights as a consumer.
Article 10 - Competent court :
In case of failure of a mutual agreement, any dispute arising under these conditions is within the exclusive jurisdiction of the Tribunal de Commerce de Lille.
